General Conditions of Contract · version 2 · in force from 23 October 2026
These conditions are delivered with each travel contract and form part of it.
1. Who we are and in what capacity we act
Travel Xperience is the brand of Viatges Experiencia 2010, SL, a travel agency established in the Principality of Andorra (Principat d'Andorra), NRT L-711815-P, registered in the Registre de Comerç under No. 927262T and in the Registre de Societats under No. 16706, with registered office at Carrer dels Pradassos 3, 1r pis, porta 2, AD300 Llorts, and office open to the public at Avinguda Tarragona 51, AD500 Andorra la Vella. Telephone +34 911 875 940 (for incidents during the trip, the same number, option 5, staffed 24 hours) · e-mail info@travel-xperience.com · website www.travel-xperience.com.
We specialise in accessible travel for persons with a disability or reduced mobility, for travellers from any country and to any destination. We are the organiser of the trips we sell: tailor-made trips, designed for each traveller and contracted directly with the service providers. Only exceptionally do we sell a trip organised by another operator; in that case the contract says so and states the identity of that organiser, who is liable for the performance of the trip, and the Agency is liable for its own scope of management in accordance with clause 11.
Travel contracts are governed by the legislation of Andorra, in particular by Llei 7/2026, del 30 d'abril, general de turisme, insofar as it regulates travel agencies and tourism service providers; by Llei 13/2013, del 13 de juny, de competència efectiva i protecció del consumidor; and by general Andorran civil law. In addition, the Agency assumes, as a contractual commitment towards the traveller, the guarantees set out in these conditions, which follow the European standard for package travel (Directive (EU) 2015/2302). Nothing agreed herein limits the rights that the applicable law confers on the traveller and that cannot be waived.
2. How a trip is contracted
- The Agency prepares a travel proposal (quotation, itinerary and services) with the pre-contractual information in clause 3, including, at the traveller's request, precise information on the suitability of the trip for their accessibility needs.
- Once the proposal has been accepted, the traveller pays the deposit indicated and the Agency asks each service provider to confirm the services. If any service cannot be confirmed, the Agency offers another of similar characteristics, with its price; the traveller may accept or reject it and, if they reject it, the deposit is refunded within fourteen calendar days.
- Once the services have been confirmed, the Agency issues the travel contract with the particular conditions and these General Conditions in their current version, and sends it to the traveller for electronic signature. The contract binds the Agency from the moment it is sent and the traveller from the moment they sign it; it is concluded in Andorra.
- Before departure, the Agency delivers the travel documents (vouchers, tickets, timetables, check-in and reporting deadlines, contacts at the destination and the on-call telephone number: +34 911 875 940, option 5).
3. Pre-contractual information
Before contracting, the traveller receives the information on the trip: the destination, itinerary, periods of stay, dates and number of nights; the means of transport, their characteristics and categories, the points, dates and times of departure and return, duration, stopovers and connections; the location, main features and category of the accommodation; the meals provided; the visits, excursions or other services included; whether any service is provided as part of a group and the approximate size of the group; the minimum number of persons required and the deadline for cancellation if it is not reached; the language in which the services are provided; whether the trip is generally suitable for persons with reduced mobility and, at the traveller's request, precise information on its suitability taking into account their needs; the trading name, full address, telephone number and e-mail address of the Agency and, where applicable, of the organiser; the total price including all taxes and, where applicable, fees, surcharges and additional costs, or the type of costs the traveller may have to bear; the arrangements for payment, down payment and time limits; general information on passport and visa requirements, approximate time periods for obtaining them and health formalities; the possibility of terminating the contract before the start of the trip in return for the standard cancellation charge set out in the particular conditions; the possibility of taking out optional cancellation insurance and assistance insurance, including the costs of repatriation in the event of accident, illness or death; and the data protection information in clause 19.
4. Price: what it includes, what it does not include and how it is revised
It includes what the contract specifies and, where the service is included in the contract: outward and return transport of the type, characteristics and category stated; accommodation in the establishment and on the board basis stated; the taxes and charges on the contracted services known at the date of the contract, except those payable directly at the destination; the 24-hour on-call telephone line for incidents during the trip; advice before and after confirmation on the accessibility of the destination and of the services; and all other services and extras stated in the contract.
It does not include, unless the contract states otherwise: visas, entry authorisations and vaccination certificates; taxes or charges payable directly at the destination (for example, local tourist taxes); “extras” such as coffees, drinks, laundry, optional hotel services and special diets not agreed; optional excursions or visits not booked before departure, which do not form part of the contract, whose published price is an estimate and which are not guaranteed to take place until they are booked at the destination; tips (on cruises, the contribution to service staff set by the shipping company); on snow holidays, ski passes and lessons; services not covered by the hotel's “all-inclusive” package; and, in general, any service not expressly stated in the contract.
Revision. The total price of the trip is the price stated in the particular conditions and includes all taxes and charges known at the date of signing. After signing, the price may be revised, upwards or downwards, only as a direct consequence of changes in: a) the price of carriage of passengers resulting from the cost of fuel or other power sources; b) the level of taxes or fees on the travel services included in the contract imposed by third parties not directly involved in the performance of the trip, including tourist taxes and landing, embarkation or disembarkation fees at ports and airports; c) the exchange rates relevant to the trip. The revision will pass on exactly the amount of the change to the price of the service affected. The Agency will notify the traveller of any increase, with its justification and calculation, in writing and no later than twenty calendar days before the start of the trip. Any reduction resulting from a decrease in those same costs will apply up to the start of the trip; the Agency may deduct its actual administrative expenses from the refund, and will substantiate them if the traveller so requests. If the increase exceeds 8% of the total price, the traveller may, within three calendar days of the notification, accept it, accept the substitute trip offered by the Agency, or terminate the contract without a cancellation charge, with a refund of all amounts paid within fourteen calendar days; if the traveller does not communicate their decision within that period, they will be deemed to have chosen to terminate the contract without a cancellation charge.
5. Payments, non-payment, refunds and invoice
The contract sets the deposit and the payment schedule. The deposit covers, as a minimum, the services that the Agency must pay to the service providers in advance (tickets, insurance, hire of special equipment and specific transport); the balance is paid on the dates in the schedule and, in any event, before the travel documents are delivered. Prices are in euros; bank charges and fees for transfers, including international transfers, are payable by the traveller, so that the Agency receives the full amount.
Methods of payment: bank transfer to the Agency's account stated on the invoice or in the payment request (account holder Viatges Experiencia 2010, SL) or bank card through our bank's secure payment gateway. Payment by transfer may delay confirmation of the services until the funds have been credited. The Agency never notifies a change of bank account by e-mail or by messaging app: if you receive any such message, confirm it with the Agency by telephone before paying.
If an instalment is not paid on its due date, the Agency will require payment in writing within five calendar days; if payment is not made, it may terminate the contract, applying the cancellation charge applicable at that date.
All refunds are made through the Agency, by the same means as was used for payment, within the period set by the applicable clause; the amount of any services voluntarily not used by the traveller is not refunded. The Agency issues the invoice for the total amount of the trip in accordance with Andorran regulations; where it applies a cancellation charge, it will substantiate, at the traveller's request, the non-recoverable costs that make it up.
6. Minimum number of participants
Where the trip requires a minimum number of persons registered, that number and the deadline are stated in the contract. If that minimum is not reached, the Agency may cancel the contract by notifying the traveller in writing no later than: twenty calendar days before the start if the trip lasts more than six days; seven calendar days before if it lasts between two and six days; forty-eight hours before if it lasts less than two days. In that case the Agency will refund all amounts paid within a maximum of fourteen calendar days, without additional compensation.
7. Transfer of the booking
The traveller may transfer the contract to a person who satisfies all the conditions applicable to the trip, by notifying the Agency in writing at least seven calendar days before the start of the trip. The transferor and the transferee are jointly and severally liable for the balance due and for the actual costs of the transfer. Those costs will be the costs charged by the service providers, in particular for the change of name or reissue of named tickets, which on non-changeable fares may not be possible or may amount to a new ticket, plus the handling fees for modification of the particular conditions; the Agency will inform the transferor of the amount before the transfer and will substantiate it on request.
8. Required documentation
The personal and family documents of all passengers, including children, must be in order, and the traveller must check that the passport, visa or identity document are those required by each country of destination and transit. The Agency provides the traveller with general information on passport and visa requirements, approximate time periods for obtaining them and the health formalities of the trip, which are set out in the particular conditions. Obtaining the passport, visas and entry or transit authorisations (for example, ESTA, ETIAS, eTA) is the traveller's responsibility. If an authority rejects the documentation or refuses entry because the requirements are not met or because the documentation is not carried, this will not be considered force majeure: the Agency will not be liable for any additional expenses or refund the price of the trip, and the termination cancellation charge applicable at that date will apply. Minors under 18 must carry an identity document or passport and, when not travelling with their parents or guardians, a written authorisation from them granted before the competent authority. Where a minor travels without a relative or other authorised adult and the trip includes accommodation, the contract states the direct contact with the minor or with the person responsible for the minor at the destination. Since entry, exit and transit requirements vary by nationality and may change without notice, the traveller will check them with the authorities of their country of nationality and with the embassies or consulates of the countries of destination and transit.
9. Alteration of the trip by the Agency
The Agency reserves the right to alter unilaterally, before the start of the trip, contract terms other than the price only if the change is insignificant and it informs the traveller of it clearly in writing. If, before the start of the trip, the Agency is constrained to alter significantly any of the main characteristics of the services, cannot fulfil any of the special requirements accepted in the particular conditions, or proposes a price increase of more than 8%, it will inform the traveller without delay and in writing, stating: the proposed changes and their impact on the price; the period of three calendar days in which to respond; that, if the traveller does not respond within that period, they will be deemed to have chosen to terminate the contract without a cancellation charge; and, where applicable, the substitute trip offered and its price. The traveller may accept the change, accept the substitute trip or terminate the contract without a cancellation charge, with a refund of all amounts paid within fourteen calendar days. If the change or the substitute trip results in a trip of lower quality or cost, the traveller is entitled to an appropriate price reduction.
10. Termination by the traveller, cancellation by the Agency and cancellation charges
The traveller may terminate the contract at any time before the start of the trip by notifying the Agency in writing at info@travel-xperience.com; the Agency will acknowledge receipt by the same means, and the date of receipt determines the applicable cancellation charge. In that case the traveller will pay the standard cancellation charge set in the particular conditions, based on how far in advance the termination takes place and on the expected cost savings and income from alternative deployment of the services that the Agency may obtain; in the absence of a standard cancellation charge, the cancellation charge will be the price of the trip minus those cost savings and that income. The Agency will provide the traveller, on request, with a justification of the amount.
Standard cancellation charge for individual and tailor-made trips. The traveller will pay: a) the cancellation handling fees stated in the contract; b) the amounts already committed by the Agency for that traveller that cannot be recovered under the conditions of each service provider: tickets issued at a non-refundable fare, insurance premiums and bookings of accommodation, visits, rentals or transfers without free cancellation, which the Agency will substantiate on request and of which it will refund whatever it recovers; and c) on the remainder of the price, 5% if termination occurs between two months and fifteen days before the start of the trip, 15% between fifteen and three days before, and 50% within the forty-eight hours before. In no case will the sum of a), b) and c) exceed the total price of the trip.
Standard cancellation charge for group trips. Until notification of the confirmation of the trip and of the group, the traveller may terminate without a cancellation charge, with a full refund within fourteen calendar days. From that notification onwards, the cancellation charge is the total price of the trip, because at that point the Agency has contracted and paid on a firm basis for the group's common services and a place that is released cannot be filled with the necessary notice; the Agency will refund to the traveller whatever it recovers from the service providers in respect of the traveller's direct and individual costs and, if another traveller takes their place, the amount for the common services paid by that traveller, less the handling fees for the substitution, and will substantiate on request the amounts retained and recovered.
In the event of unavoidable and extraordinary circumstances occurring at the place of destination or its immediate vicinity and significantly affecting the performance of the trip or the carriage of passengers to the destination, the traveller may terminate the contract before the start of the trip without paying any cancellation charge, with a full refund of the amounts paid and without additional compensation. The Agency may cancel the contract and refund all amounts paid, without additional compensation, if a) the number of persons registered is lower than the minimum in clause 6 and the Agency gives notice within the period set in that clause, or b) the Agency is prevented from performing the contract because of unavoidable and extraordinary circumstances and gives notice without undue delay before the start of the trip. If the Agency cancels the trip for any other reason, it will refund the amounts paid in full and compensate the traveller in accordance with clause 11. Any refund will be made within a maximum of fourteen calendar days of termination. A no-show at departure without prior termination is considered termination at that moment, and the traveller will owe the total price of the trip. Insurance premiums are non-refundable.
11. Liability of the Agency and assistance
Liability. The Agency is liable to the traveller for the proper performance of all the travel services included in the contract, irrespective of whether those services are performed by the Agency itself or by other service providers, without prejudice to its right of recourse against the service provider responsible. The traveller must inform the Agency without undue delay, through the point of contact in clause 12, of any lack of conformity perceived during the trip. If any service is not performed in accordance with the contract, the Agency will remedy the lack of conformity, unless that is impossible or entails disproportionate costs, taking into account the seriousness of the lack of conformity and the value of the services affected; if the Agency does not remedy it within a reasonable period set by the traveller, the traveller may do so themselves and request reimbursement of the necessary expenses. If a significant proportion of the services cannot be provided as agreed, the Agency will offer, at no extra cost, suitable alternative arrangements, of equivalent or higher quality where possible, or with an appropriate price reduction if they are of lower quality; if no alternatives are available or the traveller rejects them because they are not comparable, the traveller will be entitled to a price reduction and, where appropriate, to compensation and, if the trip includes transport, to repatriation with equivalent transport at no extra cost and without undue delay. The traveller is entitled to an appropriate price reduction for any period during which there was a lack of conformity, unless it is attributable to the traveller, and to appropriate compensation for any damage sustained as a result of it, unless the Agency proves that the lack of conformity is attributable to the traveller, to a third party unconnected with the provision of the services and is unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances.
In the exceptional case where the Agency sells a trip organised by another operator (clause 1), that organiser is liable for the performance of the services, the remedies and the assistance under this clause, and the Agency is liable for its own scope of management: the pre-contractual information, the booking and contracting, the collection and making of payments, and the handling of complaints. The Agency will forward to the organiser, without delay and with acknowledgement of receipt, any lack of conformity or complaint notified to it by the traveller, will keep the traveller informed of its progress and will provide such help as is within its power while the organiser responds.
Assistance. The Agency will give appropriate assistance without undue delay to a traveller in difficulty, in particular in the event of unavoidable and extraordinary circumstances: information on health services, local authorities and consular assistance; help to make distance communications and to find alternative travel arrangements. It may charge a reasonable fee for such assistance, not exceeding the actual cost, if the difficulty was caused intentionally by the traveller or through their negligence. If it is impossible to ensure the return on the scheduled date because of unavoidable and extraordinary circumstances, the Agency will bear the cost of the necessary accommodation, if possible of equivalent category, for up to three nights per traveller. This three-night limit does not apply to persons with a disability or reduced mobility or their companions, pregnant women, unaccompanied minors or persons in need of specific medical assistance, provided their needs have been notified to the Agency at least forty-eight hours before the start of the trip, nor where the passenger rights legislation applicable to the return transport provides for longer periods for the carrier.
Limits. Insofar as international conventions limit the extent of, or the conditions under which, compensation is to be paid by providers of travel services included in the contract, in particular the Montreal Convention for air transport, the same limitations apply to the Agency. In other cases, compensation payable by the Agency is limited to three times the total price of the trip; this limit does not apply to personal injury or to damage caused intentionally or with negligence. The traveller's rights against carriers, in particular those conferred by Regulations (EC) No 261/2004 and No 1107/2006 and by international conventions, are not affected by these conditions; any compensation or price reduction obtained by one route will be deducted from that obtained by another in order to avoid overcompensation.
12. Contact during the trip
During the trip, to request assistance or report a lack of conformity, the traveller can contact the Agency on +34 911 875 940 and at info@travel-xperience.com and, for incidents arising during the trip, on the same telephone number, option 5, staffed 24 hours. On group trips, the Agency's representative at the destination (tour leader) and their telephone number are stated in the contract.
13. Specific features of the services
Flights. The operating carrier is the one stated in the contract; if it is not known at the time of signing, the Agency informs the traveller of the carrier likely to operate the flight and of any subsequent change. Travellers must report at the airport with the advance notice indicated in the travel documents and, for passengers who have requested assistance, at the time set in writing by the airline or, if none is set, at least two hours before the published departure time. It is recommended that flight times be reconfirmed forty-eight hours before departure. The Agency handles seat requests according to the traveller's needs free of charge, but is not liable for changes decided by the airline at boarding; if the traveller has paid for specific seats and the airline does not assign them, the Agency will refund their cost within fourteen calendar days of the traveller providing evidence that they were not assigned, and will assist them with the claim against the airline. A flight is direct when it is covered by a single flight coupon, even if it makes a technical stop.
Hotels. The category is the official category of the country; where it is indicated in stars using the Agency's own criteria, it is for guidance only. Triple or quadruple rooms are double rooms with extra beds, and are deemed accepted by their occupants when so stated in the contract. Unless otherwise agreed, rooms are available from 14:00 on the day of arrival and must be vacated before 12:00 on the day of departure; the accommodation service is deemed to have been provided even if, owing to the travel schedule, check-in takes place later. Double bed: not guaranteed unless expressly confirmed. If the traveller expects to arrive on a different date or at a different time than scheduled, they must inform the Agency or the hotel in advance. Animals are only admitted if the hotel confirms it and it is so stated in the contract; assistance dogs are subject to the rules of the destination and are notified to the service providers together with the other accessibility needs. For flights arriving after 12:00, the first hotel service is dinner; for flights arriving after 19:00, it is the accommodation.
Adapted room. Where the contract includes an adapted room, before confirming the booking the Agency verifies, by means of photographs or a visit, that the bathroom and the room meet the needs declared by the traveller, makes those photographs available to the traveller for validation, obtains from the establishment (and from the booking supplier, where it provides one) written confirmation of the allocation of the adapted room, and reconfirms it with the establishment seventy-two hours before arrival and on the day of arrival. If on arrival the hotel does not have the confirmed adapted room available, the Agency will make every effort to relocate the traveller to an adapted room in the same hotel or in another of the same or higher category; if this is not possible, it will refund the cost of the room not used and, where applicable, apply the price reduction and compensation under clause 11. The Agency is not liable for defects due to lack of maintenance of adapted features that are not attributable to it, but will claim for them against the establishment and pass on to the traveller whatever it obtains.
Apartments. The traveller is responsible for declaring the exact number of occupants, including children; the management may refuse entry to persons not declared. Extra beds and cots must be requested before contracting and are not included unless expressly stated.
Children. The prices and terms for children depend on their age, the service provider and the date; they are provided in each case and set out in the contract. For accommodation, they apply when the child shares a room with two adults.
Tours and ground transport. On tours, the type of vehicle may vary according to the number of participants; if the group is small, a minibus or van may be used. The accessibility of the vehicle (ramp, lift platform, tie-downs) is as stated in the contract. Accommodation on tours is provided in the establishments indicated or, if they have no availability, in others of the same category and area, which does not constitute an alteration of the contract when the programme so provides.
Supplementary services and offers. Supplementary services requested (sea view, etc.) that cannot be confirmed are not charged or are refunded immediately. In special or last-minute offers, the services included are solely those detailed in the offer.
Connecting flights from the place of origin. Where there is no connection from the traveller's city of origin to the starting point of the contracted trip, any overnight costs this entails are borne by the traveller, unless that transport is included in the contract.
14. Luggage and mobility equipment
Luggage. In air, rail and sea transport the conditions of each carrier apply, and the ticket is the document that binds the passenger to the carrier. In the event of damage, delay or loss, the traveller must submit the claim to the carrier on the spot (for checked baggage on flights, in writing and no later than seven days after receiving it damaged); the Agency will assist the traveller with the claim. In ground transport contracted by the traveller independently, luggage travels in the traveller's custody.
Mobility equipment and assistive devices. They are not luggage: they are part of the person travelling. Airlines subject to Regulation (EC) No 1107/2006 carry free of charge up to two items of mobility equipment per person with a disability or reduced mobility, in addition to medical equipment, with forty-eight hours' prior notice and subject to available space and to battery rules; the Agency gives that notice using the details declared by the traveller in the contract. In the event of loss of or damage to equipment during handling at the airport or during air transport, the carrier is liable in accordance with international conventions, with limits that may be lower than the value of the equipment: the traveller may make a special declaration of value at check-in or insure the equipment, and the Agency will assist them with the claim. On transfers and ground transport organised by the Agency, the Agency is liable for mobility equipment in accordance with clause 11.
15. Accessibility and persons with reduced mobility
A person with a disability or reduced mobility means any person whose mobility when using transport is reduced due to any physical, sensory or intellectual disability, whether permanent or temporary, or due to age, and whose situation needs appropriate attention and the adaptation to their needs of the service made available to other travellers. So that the Agency can assess the feasibility of the trip and organise the assistance, the traveller informs the Agency before booking of their situation, their assistance needs, whether they are travelling with a companion and the mobility equipment with which they are travelling (type, make and model, dimensions, weight and battery), and declares them in the contract. With that information the Agency: notifies the airlines and the airport managing bodies at least forty-eight hours before each flight; verifies the adapted accommodation (clause 13); contracts the accessible transfers and activities stated in the contract; and informs the traveller of the conditions that each airline applies to their equipment. Any changes of equipment or needs after signing must be notified to the Agency and, if received less than forty-eight hours in advance, may not be accepted by the service providers. Airlines may require the person to travel accompanied for safety reasons. The rights to assistance and to free carriage of equipment described here apply to flights departing from, arriving at or transiting through airports in the European Union and to flights to the European Union operated by Community carriers; in other countries the conditions of each airline and local legislation apply, which the Agency checks with the airline before confirming the flight. Health and accessibility data are processed in accordance with clause 19, solely to organise the trip and request the assistance.
16. Group trips
The prices of group trips are calculated for the minimum number of travellers indicated in each programme, who travel the itinerary together from the group's joining point; a larger group does not reduce the price. Each adult traveller signs their own contract; minors and persons who cannot sign for themselves are included in the contract of the responsible adult. The trip is confirmed when the minimum is reached by the deadline set in the contract; if it is not reached, the Agency may cancel it with a full refund or offer to maintain it with a supplement per place, which each traveller may accept or reject. Cancellation by the traveller is governed by clause 10. For organisational and safety reasons, the tour leader or guide holds the documentation for the group's accommodation bookings, tickets and other services. Harmonious coexistence within the group is a condition for the smooth running of the trip: the Agency may, after a written warning, exclude from the group anyone who endangers their own or others' safety or seriously disrupts the trip; in that case it will help to organise their return, at the traveller's expense, and the amount for unused services will not be refunded. No one will ever be excluded on the grounds of their disability or of the assistance needs they have declared.
17. Insurance
Before contracting, the Agency informs each traveller of the option of taking out cancellation insurance, covering the costs of terminating the contract, and travel assistance insurance, covering medical and repatriation costs in the event of accident, illness or death, and provides them with the policy terms and conditions and the information document for each insurance they take out. The Agency offers AON's assistance and cancellation insurance under the plan corresponding to the traveller's residence (resident in Spain or resident in another country); the geographical scope and the limits are those set in each certificate, costs arising from the aggravation of pre-existing or chronic conditions are subject to a separate limit, and wheelchairs and medical devices are treated as valuables with limited cover within luggage, so the traveller should consider insuring them separately or making a declaration of value to the airline (clause 14). The Agency acts as intermediary; premiums are non-refundable; the cover, exclusions, time limits and documentation for each claim are those set out in the policy terms and conditions, and the Agency helps the traveller to prepare the claim.
18. Complaints
Without prejudice to their obligation to report any lack of conformity during the trip, the traveller may submit a written complaint to the Agency at info@travel-xperience.com or at the Agency's office, Avinguda Tarragona 51, AD500 Andorra la Vella, Andorra. The Agency will acknowledge receipt, forward the complaint to the service provider concerned within seven days, keep the traveller informed of the progress of the complaint and give a reasoned response within a maximum of one month of its submission. The Agency makes available to the traveller the official complaint and report forms of the Govern d'Andorra (www.consum.ad); the traveller may also apply to the Servei de Consum of the Govern d'Andorra, which offers a mediation procedure, to which the Agency will decide on a case-by-case basis whether to submit. Where the Agency sells a stand-alone travel service (for example, only a ticket or only accommodation) and not a package, it will expressly state this in the particular conditions; in that case the service is governed by the service provider's conditions and the Agency is responsible for the proper handling of the booking.
19. Data protection
Controller: Viatges Experiencia 2010, SL, with registered office at Carrer dels Pradassos 3, 1r pis, porta 2, AD300 Llorts, and office at Avinguda Tarragona 51, AD500 Andorra la Vella, Andorra, info@travel-xperience.com. Purposes: managing the booking, the contract and the performance of the trip; communicating with the traveller; invoicing and complying with the Agency's legal obligations; and, only if the traveller expressly authorises it, sending them information about the Agency's trips. Legal basis: the performance of the contract and legal obligations; for commercial communications, consent. Health, disability and assistance-needs data: the Agency processes these data solely to organise the trip in accessible conditions and to request the assistance the traveller needs, and discloses them to the service providers that must provide that assistance (airlines, airport managing bodies, hotels, carriers, ground handlers and insurers), including those located outside Andorra and the European Union, in the country of destination or transit; without that disclosure the assistance cannot be provided. The traveller gives their express consent to that processing and that disclosure in the contract. Retention: for the duration of the relationship and, thereafter, for the period required by the Agency's legal obligations and liabilities. Rights: access, rectification, erasure, objection, restriction and portability, in writing to the postal or e-mail address indicated, with proof of identity where there is reasonable doubt about it; the traveller may use the form provided by the Agència Andorrana de Protecció de Dades (APDA, www.apda.ad, tel. 808 115, C. Doctor Vilanova 15-17, planta -5, Andorra la Vella) and lodge a complaint with the APDA and, if resident in the European Union, with the supervisory authority of their country.
20. Images of the trip
During the trip, the Agency or the persons representing it (tour leader, guides) may take photographs and videos in which travellers appear, and use them on its website, on its social media and in its commercial and advertising material to promote its trips. By signing the travel contract the traveller is informed of this and authorises such use of their image. If the traveller does not wish to appear in such publications, they may at any time exercise their right not to appear by writing to info@travel-xperience.com; the Agency will stop using their image, will remove it within a reasonable period from the publications in which it appears and will not take any further images of them for that purpose. This authorisation is free of charge, is not a condition of the contract or of the service, and does not extend to minors or to persons unable to consent for themselves, whose image will only be used with the express written authorisation of their parents or guardians.
21. Applicable law and jurisdiction
Travel contracts are concluded in Andorra, at the Agency's domicile, where the traveller accepts the offer, and are governed by Andorran law. For any dispute arising from the contract or its performance, the parties submit to the jurisdiction of the courts of Andorra.
22. Language, version and order of precedence
The contract and these conditions are issued in Catalan, the official language of the Principality of Andorra, and in the traveller's language (Spanish, English, French or Portuguese). Both versions have the same value; if they differ, the interpretation most favourable to the traveller applies. These General Conditions, in the version in force at the date of the contract, are delivered with each travel contract and form part of it; the version and its date appear in the heading. The particular conditions of the contract prevail over these General Conditions, unless the General Conditions are more favourable to the traveller. The Agency keeps previous versions and provides them to anyone who requests them.
